Terms of Service

Last updated: January 2025. Please read these terms carefully before using Scravity.

1. Acceptance of Terms

By creating an account, accessing our platform, or using any of our APIs ("Services"), you agree to be bound by these Terms of Service ("Agreement"), our Privacy Policy, and all applicable laws and regulations. If you do not agree with any part of these terms, you must not use the Services.

Scravity provides stealth browser and web automation infrastructure, including a managed browser API with fingerprint spoofing, proxy rotation, anti-bot bypass, and data extraction tools. We provide the technical infrastructure; you retain full responsibility for how you use these tools and for ensuring compliance with all applicable laws and target website terms.

2. Account Responsibilities

To access certain features of our Services, you must create an account. By registering, you confirm that:

  • You are at least 18 years old or the age of majority in your jurisdiction
  • All information you provide is accurate, current, and complete
  • You will safeguard your account credentials and API keys
  • You accept responsibility for all activities that occur under your account

You must notify us immediately if you suspect unauthorized use of your account or any security breach. You remain liable for all actions taken until such notification is received.

3. Usage Limits and Fair Use

Your use of the Services is subject to usage limits, rate limits, and concurrency restrictions based on your credit plan. These limitations exist to:

  • Prevent abuse or misuse of the stealth browser infrastructure
  • Maintain service quality and availability for all users
  • Protect target websites from excessive automated requests
  • Ensure compliance with our upstream provider obligations

We reserve the right to adjust limits, throttle sessions, or temporarily suspend access if we detect patterns indicative of abuse, automated attacks, or behavior that may harm our infrastructure or violate these terms. We will provide reasonable notice when possible, except in cases requiring immediate action for security reasons.

4. Acceptable Use and Your Responsibilities

Scravity provides neutral browser automation infrastructure. We do not control, monitor, or endorse how you use the Services. You acknowledge and agree that:

  • You are solely responsible for ensuring your use complies with all applicable laws, regulations, and the Terms of Service of any websites you access through our stealth browser
  • You indemnify Scravity against any claims, damages, or legal actions arising from your use of the Services
  • You will not use the Services for any unlawful purpose, including but not limited to: violating data protection laws, infringing intellectual property rights, engaging in fraud, or accessing unauthorized systems
  • You will not resell, redistribute, or attempt to reverse-engineer our stealth browser infrastructure without explicit written permission

We cooperate fully with lawful investigations and will disclose account information when required by valid legal process. We reserve the right to terminate accounts engaged in serious or repeated violations without prior warning.

5. Payments and Billing (Processed via Paddle)

5.1 Payment Processor

All payments for Scravity services are processed by Paddle.com, who acts as our authorized Merchant of Record and reseller. When you make a purchase, you are entering into a transaction with Paddle, subject to both this Agreement and Paddle's own terms and conditions.

For complete details regarding Paddle's buyer terms, privacy practices, and policies, please visit:

5.2 Pricing and Credits

Our services operate on a credit-based system. All purchases are processed in advance, and credits are added to your account immediately upon successful payment. Credit pricing, plans, and available packages are displayed on our pricing page and are subject to change. Price changes apply only to future purchases; existing credits retain their purchased value.

5.3 Subscription Plans

For subscription-based plans, billing occurs automatically at the start of each billing period (monthly or annually, as selected). You may cancel your subscription at any time through your account settings or by contacting support. Cancellation takes effect at the end of the current billing period; no partial refunds are provided for unused time within an active billing cycle.

5.4 Taxes

Paddle handles calculation, collection, and remittance of applicable sales taxes, VAT, or GST based on your location. The total amount displayed at checkout includes all applicable taxes.

6. Refund Policy

6.1 General Policy

Unless required by applicable law, all purchases are non-refundable and non-exchangeable. This reflects the nature of digital services where delivery and access are immediate upon purchase, and credits can be consumed instantly.

6.2 Your Consumer Rights

Depending on your location and local consumer protection laws, you may have statutory rights to withdraw from a purchase within a specified cooling-off period (commonly ranging from 5 to 14 days depending on your jurisdiction). These rights typically apply only when:

  • No credits have been consumed or browser sessions have been launched using the purchased amount
  • The service has not been actively used
  • You have not waived your withdrawal rights by commencing use of the service

Where local laws provide greater consumer protections than stated here, those laws prevail. Nothing in this policy limits your mandatory statutory rights as a consumer.

6.3 Discretionary Refunds

In certain circumstances, Paddle may consider refund requests on a discretionary, case-by-case basis. Factors considered include the reason for the request, usage history, and timing. Submission of a request does not guarantee approval, and any discretionary refund granted is voluntary without creating future obligation.

6.4 Technical Issues

If you experience persistent technical issues that materially prevent you from using paid stealth browser features as described, please contact Scravity support first to attempt resolution. If unresolved, you may escalate to Paddle support for review under their defect and consumer protection policies.

6.5 How to Request a Refund

For full details on eligibility criteria, timeframes, and procedures specific to your situation and location, please refer directly to:

Eligible refunds are processed to the original payment method. Upon refund issuance, access to relevant services/credits ceases immediately.

7. Account Closure and Data Deletion

You may request permanent account deletion at any time by emailing:

support@scravity.com

Please include your registered email address and reason for deletion request. Upon confirmation:

  • Your account and all associated data will be permanently deleted within 30 days
  • All remaining unused credits will be forfeited and are non-refundable
  • Active subscriptions will be cancelled effective immediately (no prorated refund for unused time)
  • This action cannot be undone; you would need to create a new account to use our services again

Alternatively, you may simply stop using the service and let any active subscription expire naturally if you wish to retain the option to return.

8. Service Availability and Warranties

The Services are provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory. Specifically, but without limitation:

  • We do not guarantee uninterrupted, timely, secure, or error-free stealth browser operation
  • We do not warrant that the Services will meet your specific automation requirements or expectations
  • We do not guarantee that data extracted through browser sessions will be accurate or reliable
  • We do not guarantee that defects in the Services will be corrected

While we strive for high availability, maintenance windows, updates, infrastructure changes, or factors beyond our control (including upstream provider outages or anti-bot system changes by target websites) may cause temporary degradation or downtime. We provide no uptime service level agreement (SLA) unless explicitly specified in a separate written enterprise agreement.

9. Limitation of Liability

To the maximum extent permitted by applicable law:

  • Scravity, its founders, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of or inability to use the Services
  • Total liability for any claims shall not exceed the amount you paid to Scravity in the twelve (12) months preceding the claim
  • We are not responsible for damages resulting from: target websites updating their anti-bot systems, data accuracy of extracted content, your reliance on extracted data for business decisions, or any actions taken based on data obtained through our Services
  • Some jurisdictions do not allow exclusion of consequential damages; the above limitation may not fully apply to you

This limitation applies regardless of the legal theory (contract, warranty, tort, negligence, or otherwise) and even if advised of the possibility of such damages.

10. Suspension and Termination

10.1 Termination by You

You may stop using the Services at any time. For subscription accounts, cancel through your settings or contact support to prevent future billing. See Section 7 for account deletion procedures.

10.2 Termination by Scravity

We reserve the right to suspend or terminate your access to the Services immediately, without prior notice or liability, for any reason, including (but not limited to):

  • Breach of these Terms of Service
  • Suspected fraudulent, abusive, or illegal activity
  • Extended periods of account inactivity (greater than 12 months)
  • Requests from law enforcement or regulatory authorities
  • Business decisions to discontinue certain features or the entire service
  • Risk to our stealth browser infrastructure, reputation, or other users

Upon termination, your right to use the Services ceases immediately. Provisions that by their nature should survive (indemnification, liability limitations, governing law) continue in effect.

11. Changes to Terms and Service

We may update, modify, or discontinue any aspect of the Services (including features, pricing, or availability) at any time with or without notice. We may also revise these Terms of Service periodically to reflect:

  • Changes in our business practices or service offerings
  • New stealth browser functionality or features
  • Changes in applicable laws or regulations
  • Updates to align with our payment processor's policies

Continued use of the Services after changes become effective constitutes acceptance of the revised terms. Material changes will be communicated via email to registered users when feasible. We recommend reviewing this page periodically. The "Last updated" date at the top indicates the most recent revision.

12. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of [Jurisdiction], without regard to conflict of law principles.

Any disputes arising from or relating to these Terms or the Services shall be resolved first through good-faith negotiation between the parties. If unresolved within 30 days, disputes shall be submitted to binding arbitration under rules of [Arbitration Institution], with exclusive jurisdiction of courts in [City, Country] for matters not subject to arbitration.

Each party bears its own costs unless the arbitrator or court determines otherwise.
